Terms of Service

1. Introduction

Welcome to Courigo. These Terms of Service ("Terms") govern your access to and use of the Courigo platform, including any websites, mobile applications, and services offered by Courigo ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Acceptance of Terms

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" and "your" in these Terms refer to both you and that entity.

3. Changes to Terms

We may modify these Terms at any time. Courigo provides a courier management platform that allows users to track packages, manage customers, generate reports, send notifications, and perform other related functions. The specific features and functionality available to you may depend on the subscription plan you select.

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuation of the Services.

6. Fees and Payment

Certain aspects of the Services may be provided for a fee. You agree to pay all fees in accordance with the fees, charges, and billing terms in effect at the time a fee is due and payable. You are responsible for paying all applicable taxes associated with your use of the Services.

Payment must be made by the methods specified within the Services. You authorize us to charge your designated payment method for all fees incurred by you. If your payment method fails or your account is past due, we may collect fees using other collection mechanisms.

7. Intellectual Property

The Services and all content and materials included on or within the Services, including, but not limited to, text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are the property of Courigo or its licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services for their intended purposes, subject to your compliance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. User Content

You retain ownership of any content that you submit, post, or display on or through the Services ("User Content"). By submitting, posting, or displaying User Content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display the User Content in connection with the operation of the Services.

You represent and warrant that you have all rights, power, and authority necessary to grant the rights granted herein to any User Content that you submit; and that the use of such User Content does not violate these Terms or applicable law.

9. Prohibited Conduct

You agree not to:

  • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services;
  • Use the Services in any way that could damage, disable, overburden, or impair the functioning of the Services;
  • Violate any applicable law or regulation;
  • Upload or transmit any viruses, malware, or other types of malicious software;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services;
  • Use the Services for any illegal or unauthorized purpose;
  • Use any robot, spider, crawler, scraper, or other automated means to access the Services;
  • Circumvent or attempt to circumvent any filtering, security measures, or other features designed to protect the Services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Courigo, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

UNDER NO CIRCUMSTANCES WILL Courigo BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICES OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

11. Termination

We may terminate or suspend your access to all or part of the Services, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms, applicable law, or is harmful to the interests of another user, a third party, or us.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.
